RECENT CHANGES TO FRENCH PLANNING REGULATIONS

A summary of the recent changes to French planning regulations

Recent legislative amendments have introduced changes to certain planning regulations in France. The two main ones concerning Planning Permit applications are as follows:

(1) SHON and SHOB replaced

The way in which the surface area is referred to in Planning Permit applications has been modified. The 'SHON' (Surface Hors Oeuvre Nette) and 'SHOB' (Surface Hors Oeuvre Brute) have been replaced by the Surface du Plancher and Emprise au Sol

(2) Constructions below a surface area of 40 m2

In those communes where there are local planning regulations (PLU, POS or other, such as carte communale), for new constructions where there is an existing building in urban zones, the surface area above which a Planning Permit is required for new constructions such as a shed, garage and extension has been raised from 20m2 to 40m2. Below this surface area, the owner must submit a simple Déclaration des Travaux to the Mairie.

MODIFICATIONS RECENTES AUX AUTORISATIONS D'URBANISME

Un sommaire des modifications récentes aux autorisations d'urbanisme.

Des amendements législatifs ont modifiés des règles d'urbanisme applicables en France. Les principales modifications concernent les demandes de Permis de Construire comme suit:

(1) Remplacement des SHON et SHOB

Dans les demandes de Permis de Construire, les surfaces SHON (Surface Hors Œuvre Nette) et SHOB (Surface Hors Œuvre Brute) ont été remplacées par les termes suivants Surface du Plancher et Emprise au Sol

(2) Constructions en-dessous d'un seuil de 40m2

Dans les communes couvertes par un PLU, POS ou autre document en tenant lieu, tel carte communale, pour des nouvelles constructions où il y a un bâtiment existant dans les zones urbaines, la surface au-delà de laquelle il est nécessaire de demander un Permis de Construire a été relevée de 20m2 à 40m2. En-dessous de ce seuil, le propriétaire doit soumettre une simple Déclaration des Travaux à la mairie.
